Right of Way Management
What is the Right of Way?
Broadly defined, the right of way (ROW) is the City owned space between private property lines in which public infrastructure facilities are located. This could include our roadways, traffic control systems, street lights, sidewalks, shared use paths, boulevards, landscaped areas, and utility networks (sewer, water, communications, gas, etc.).
Right of Way Management
The City of Fargo Engineering Department's Engineering Services Division is responsible for the management of the City's ROW. The overarching goal of the City's management policy is to promote and maintain the safe and orderly use of the public ROW. This includes the approval and coordination of all activities taking place within the ROW, along with the enforcement of all City policies and codes relating to its use.
More specifically, the ROW management team:
- Develops ROW use policy
- Issues ROW use permits
- Enforces ROW policy & ordinance

Encroachment Policy
As part of its long term planning efforts, it's the City's goal to develop its public ROW areas into more pedestrian friendly environments with enhanced green spaces.
