Planning Commission - June 1, 2020 Minutes
The Regular Meeting of the Board of Planning Commissioners of the City of Fargo, North Dakota, was held in the Commission Chambers at City Hall at 3:00 p.m., Tuesday, September 1, 2020.
The Planning Commissioners present or absent were as follows:
Present: John Gunkelman, Mary Scherling (via conference call), Rocky Schneider, Melissa Sobolik (via conference call), Scott Stofferahn, Maranda Tasa, Jennifer Holtz, Dawn Morgan, Art Rosenberg
Chair Gunkelman called the meeting to order.
Business Items:
Item A: Approve Order of Agenda
Chair Gunkelman noted the following Agenda items:
- Items 3, 6a, and 6b have been continued to October 6, 2020.
Member Tasa moved the Order of Agenda be approved as presented. Second by Member Morgan. All Members present voted aye and the motion was declared carried.
Item B: Minutes: Regular Meeting of August 4, 2020
Member Holtz moved the minutes of the August 4, 2020 Planning Commission meeting be approved. Second by Member Stofferahn. All Members present voted aye and the motion was declared carried.

Item 1: Delta Delta Delta Addition
Hearing on an application requesting a Plat of Delta Delta Delta Addition (Minor Subdivision) a replat of Lots 39, 40, and 41 of Subdivision of Lot Numbers 65, 66, 67, and 68 of Ohmer’s Subdivision to the City of Fargo, Cass County, North Dakota. (Located at 1313, 1315, and 1335 University Drive North) (Delta Delta Delta NHC - North Dakota State University [Epsilon Omicron Chapter] LLC/Neset Land Surveys): APPROVED
Planning Coordinator Maegin Elshaug presented the staff report stating all approval criteria have been met and staff is recommending approval.
Applicant Cole Neset spoke on behalf of the application.
Member Stofferahn moved the findings and recommendations of staff be accepted and approval be recommended to the City Commission of the proposed Subdivision Plat Delta Delta Delta Addition as outlined within the staff report, as the proposal complies with the Adopted Area Plan, the Standards of Article 20-06, and all other applicable requirements of the Land Development Code. Second by Member Schneider. On call of the roll Members Holtz, Scherling, Tasa, Morgan, Stofferahn, Rosenberg, Schneider, Sobolik, and Gunkelman voted aye. The motion was declared carried.
Item 2: Brunsdale First Addition
Hearing on an application requesting a Conditional Use Permit to allow an Alternative Access Plan for a parking reduction on a portion of Lots 2 and 3, and all of Lots 4 and 5, Block 2, Brunsdale First Addition and on a portion of Lots 4 and 6, and all of Lots 2, 3, and 5, Block 8, Marydale Addition. (Located at 3001 and 3017 University Drive South) (Aldevron LLC/Zerr-Berg Architects): APPROVED
Ms. Elshaug presented the staff report stating all approval criteria have been met and staff is recommending approval.
Discussion was held regarding the building use, confidence in the parking availability, and green space.
Applicant Representative Kevin Zachman spoke on behalf of the application.
Member Morgan moved the findings and recommendations of staff be accepted and the Conditional Use Permit be approved to allow an Alternative Access Plan as outlined within the staff report, as the proposal complies with Section 20-0909.D(1-6) of the Land Development Code, and all other requirements of the Land Development Code with the following conditions:
1) One off-street parking space to be provided for 300 square feet of medical research office use.
2) The Conditional Use Permit will cease if the medical research office use ceases.
Second by Member Tasa. On call of the roll Members Schneider, Scherling, Holtz, Sobolik, Stofferahn, Morgan, Rosenberg, Tasa, and Gunkelman voted aye. The motion was declared carried.
Item 3: Austin’s Subdivision

Item 4: Edgewood Estates Second Addition
Hearing on an application requesting a Plat of Edgewood Estates Second Addition (Minor Subdivision) a replat of Lots 9 and 10, Block 3, Edgewood Estates Addition to the City of Fargo, Cass County, North Dakota. (Located at 3619 and 3627 Parker Place North) (John Schilling/Houston Engineering): APPROVED
Planning Coordinator Donald Kress presented the staff report stating all approval criteria have been met and staff is recommending approval.
Discussion was held regarding lot sizes, maximum lot coverage, and relocation of the pipe.
Applicant Representative Brian Pattengale spoke on behalf of the application.
Member Holtz moved the findings and recommendations of staff be accepted and approval be recommended to the City Commission of the proposed Subdivision Plat Edgewood Estates Second Addition as outlined within the staff report, as the proposal complies with the Standards of Article 20-06, and all other applicable requirements of the Land Development Code. Second by Member Schneider. On call of the roll Members Scherling, Sobolik, Stofferahn, Holtz, Rosenberg, Tasa, Morgan, Schneider, and Gunkelman voted aye. The motion was declared carried.
Item 5: Cedar Crest First Addition
5a. Mr. Kress presented the staff report stating all approval criteria have been met and staff is recommending approval.
Discussion was held regarding the location of nearby residential properties, proximity to bus stops, and type of facility.
Applicant Representative Don Sterhan, Mountain Plains Equity Group, spoke on behalf of the application.
Continued discussion was held regarding amenities the property will have, sizes of the units, and requirements to become a resident of the facility.
Applicant Nate Vollmuth spoke further on the application.
Member Stofferahn moved the findings and recommendations of staff be accepted and approval be recommended to the City Commission of the proposed 1) Zoning Change from GC, General Commercial to GC, General Commercial with a PUD, Planned Unit Development Overlay, and 2) PUD, Planned Unit Development Master Land Use Plan as outlined within the staff report, as the proposal complies with the GO2030 Fargo Comprehensive Plan, the Standards of Section 20-0906.F (1-4), Section 20-0908.B (7) of the Land Development Code, and all other applicable requirements of the Land Development Code. Second by Member Morgan. On call of the roll Members Stofferahn, Tasa, Morgan, Schneider, Sobolik, Holtz, Scherling, Rosenberg, and Gunkelman voted aye. The motion was declared carried.

Item 1: MetroCOG Presentation: 76th Avenue South Corridor Study
Michael Maddox, MetroCOG, provided an informational background and overview of the 76th Avenue South Corridor Study. He shared possible options, alternatives, and access plans.
Discussion was held on a possible Interstate 29 overpass at 76th Avenue South, and the overpass at 64th Avenue South timeline.
City Engineer Brenda Derrig spoke on behalf of the Engineering Department regarding the overpass at 64th Avenue South.
