Planning Commission
The Planning Commission is an eleven member commission that meets the first Tuesday of every month. Eight members, who shall be residents of the City, are appointed by the City Commission for a three year term. The remaining three members are appointed by the Cass County Commission for a five year term. Commissioners serve at the pleasure of the appointing commission without compensation.
Members of this commission serve the community by:
- Recommending amendments to the text of the Land Development Code
- Deciding on suggested changes to The City zoning map
- Being the final reviewing authority for conditional use permits
- Reviewing Institutional Master Plans
- Reviewing major and minor subdivisions, planned unit developments and area plan applications and making recommendations to the City Commission
NDCC 40-48-03 provides for creation of a Planning Commission and allows for not more than 10 members appointed by the Mayor. It mandates appointment of three rural members in cities having a population of 25,000 or more, with these rural members appointed by the County Commission. It also states that the executive officer, the engineer and the attorney of the City shall be ex-officio members of the Commission.
North Dakota Century Code 40-47-06 states that if a city has a Planning Commission it may be appointed as the Zoning Commission.
A note in an old Ordinance book indicated that in 1964 the Zoning Commission was separated from the Planning Commission and a new and separate Zoning Commission was created by Resolution of the City Commission. Prior to that they were one group.
Chapter 20 is now included in the Land Development Code dated
February 1, 1998 and Amendments Thereto Dated February 17, 1998.
On August 27, 1974 Ordinances were adopted again combining the two Boards into the Planning Commission. (Section 20-0201 of the Fargo Municipal Code)
