Liquor Control Board - October 16, 2024 Minutes

1. Approve minutes of the August 21, 2024 regular meeting.

2. Review Liquor Applications
a. Vault Partners LLP d/b/a Fort Nok's — transfer of Class Z — adding new partner presented by Sprague no concerns with background check for Cole Jirik, recommendation to deny request based on questions answered by Anthony Lavoy.
Chief Zibolski stated there were two false statements in the application, pursuant to application qualification guidelines 25-15 #10 the application should be denied. Piepkorn stated that these situations did happened a long time ago. Chief Zibolski read aloud 25-15 #10 and would like the board to take that in to consideration when they make their decision.

b. Transfer a Class ABH from Great Plains Hospitality d/b/a Baymont Inn & Suites to University Lodging d/b/a Baymont Inn & Suites located at 1340 21 st Ave South — ownership change presented by Sprague this application will be continued, the application needed further questions answered and was referred back to PD.

3. Police Department Monthly Report
a. General Report presented by Chief Zibolski, There has been a decrease in bar checks and liquor establishment forms. Piepkorn asked about the establishment that was open after bar close. Chief Zibolski stated that situation is still under review.

4. Other Items
a. Liquor Audits updates presented by Sprague 30-35 reviews were sent to food required establishments, 70-75 are under review in regards to server training.
5 scanners have been deployed, there are still 10 available. Robyn Litke would be able to assist anyone that would like to try one.

b. License renewal updates 2nd quarter renewals were mailed and are due back October 31, they will have an expiration date of December 31st.

c. Recommendation to request the City Commission direct the City attorney to amend 25-1509 relating to alcohol service after the licensed premise is closed,

Rick Carick from Rick’s bar requested to take in to consideration that an establishment might like to close their business early and have an appreciation for their staff.

d. Recommendation to request the City Commission direct the City Attorney to make revisions to 25-15 relating to alcohol related penalties Sprague stated this was discussed at a previous working meeting. This would involve setting up a point system based on violations. This will be a lengthy process and will need to reviewed constantly as the point system is established.
This would just be a recommendation to start working on the process. Piepkorn does not feel the board is ready to start this at this time. Sprague asked if a brown bag discussion would be more appropriate at this time. Piepkorn agreed. Nelson would like to see communication with the industry in regards to this. Nelson also stated that points for rewards should also be a concept. Brekke agreed.
This item will be discussed in a brown bag meeting before a motion is made.

e. Other Sprague stated he was asked to bring ND Safety Council server training back and he believes it would be in Jan/Feb.
