Liquor Control Board - October 17, 2018 Minutes

Present: Commissioner Piepkorn, Police Chief Todd, City Auditor Sprague, Grant Larson, Environmental Health,
Absent: Commissioner Gehrig
Others Present: Assistant City Attorney Nancy Morris; Rick Carik, Rick’s; Jodi Plecity, Lakemode Liquor; John Hayes & Dave Kath, D S Beverages, Other members of the media, concerned citizens and other members of the industry.

Meeting was called to order at 9:00 A.M.

1. Commissioner Piepkorn called the meeting to order and asked if there were any additions or corrections to the minutes of September 19, 2018. There were no additions or corrections to the minutes of September 19, 2018. Moved by Chief Todd, seconded by Larson to approve the minutes of the September 19, 2018 meeting of the Liquor Control Board all voted in favor, motion passed unanimously.

2. A. The first application to be considered today is for the issuance of a Class “I” alcoholic beverage license to HRP Fargo LLC d/b/a The Tavern Grill (Grotto) to be located at 3233 45th Street South.
There were no questions or comments regarding this application.

Moved by Todd, seconded by Larson to approve the issuance of a Class “I” alcoholic beverage license to HRP Fargo LLC d/b/a The Tavern Grill (Grotto) to be located at 3233 45th Street South, all voted in favor, motion passed unanimously.

B. The second application to be considered is for the transfer of a Class B-Limited alcoholic beverage license from Lakemode Liquors d/b/a Lakemode Liquors to Hornbacher’s Inc. d/b/a Hornbacher’s Wine & Spirits to be located at 4265 45th Street South Suite #121.

Moved by Sprague, seconded by Larson to approve the transfer of a Class B-Limited alcoholic beverage license from Lakemode Liquors d/b/a Lakemode Liquors to Hornbacher’s Inc. d/b/a Hornbacher’s Wine & Spirits to be located at 4265 45th Street South Suite #121, all voted in favor, motion passed unanimously.

C. Sprague mentioned the B-Limited license only allows the owner to hold one license, Hornbacher’s is voluntarily surrendering their B-Limited liquor license at Village West. Moved by Sprague, seconded by Larson to accept the surrendered B-Limited license from Hornbacher’s for the Village West location.

3. Sprague mentioned they had a meeting with the group requesting the City look at the Point of Last Drink. Chief Todd said we currently track calls for service and complete liquor incident forms which list over serving and service to minors among other items. Commissioner Piepkorn commented the downtown is an entertainment district and more foot traffic makes for a safer environment. Chief Todd added mixed crowds help with public safety. Commissioner Piepkorn said perhaps we could get a semiannual report from PD.
Sprague mentioned the open consumption ordinance for the downtown will expire December 31, what information would the Board like gathered so a decision can be made about extending the sunset date. Commissioner Piepkorn said the events have gone well, in fact there were a reduction in the number of police incidents during these events. He would like to hear from the non-participating businesses.
Sprague mentioned they have started the annual liquor license audits.

There being no further business to come before the Liquor Control Board, the meeting was adjourned at 9:12 p.m. The next regular meeting will be held Wednesday, November 21, 2018 at 1:30 p.m. in the City Commission Room at old City Hall.
