Majority of Businesses Pass Tobacco Compliance Checks

In total, 29 business were checked across rural Cass County and West Fargo

Tobacco compliance checks were performed in West Fargo on August 15 and Cass County on August 16. In West Fargo, 13 businesses were checked and 10 passed, resulting in an 77% compliance rate. Across Cass County, 13 of the 16 passes, resulting in an 81% pass rate.

Several times per year, Fargo Cass Public Health (FCPH) partners with local law enforcement agencies to carry out tobacco compliance checks in Fargo, West Fargo, and Cass County. The intent of the checks is to ensure tobacco retailers are not selling any tobacco to people under the age of twenty-one. FCPH appreciates the cooperation of the business communities in Fargo. Licensed tobacco retailers are encouraged to periodically review City Ordinances and state laws related to sale of tobacco products and to include this important information in training for new employees.

Cass County businesses that failed:

  • Arthur Cenex - 510 S HWY 18, Arthur, ND - first fail in one year
  • City View Fuel - 13635 54 St. SE, Enderlin, ND – first fail in one year
  • West Central Ag – 310 Dakota Ave., Harwood ND – first fail in on year

West Fargo businesses that failed:

  • Casey’s General Store – 901 Main Avenue East – first fail in one year
  • Family Dollar – 144 Main Avenue E – first fail in one year
  • Petro Serve USA – 239 Main Avenue West - second fail in one year

Cass County penalties:
• A tobacco compliance failure in Cass County is considered an infraction and the penalty is imposed by the court.

West Fargo penalties:
• First failure in a one-year time period – one-year probation
• Second failure in a one-year time period – three-day suspension of the tobacco license
• Third failure in a one-year time period – ten-day suspension of the tobacco license
