LIQUOR CONTROL COMMITTEE MEETING
September 19, 2018 1:30 P.M.
Present: Commissioner Piepkorn, Police Chief Todd, City Auditor Sprague, Grant Larson, Environmental Health,
Absent: Commissioner Gehrig
Others Present: Assistant City Attorney Nancy Morris; Rick Carik, Rick’s; Dustin Mitzel, Happy Harry’s; Carol Schlossman, Downtown Neighboorhood Association, Other members of the media, concerned citizens and other members of the industry.
Meeting was called to order at 1:30 P.M.
1. Commissioner Piepkorn called the meeting to order and asked if there were any additions or corrections to the minutes of August 15, 2018. There were no additions or corrections to the minutes of August 15, 2018. Moved by Chief Todd, seconded by Larson to approve the minutes of the August 15, 2018 meeting of the Liquor Control Board all voted in favor, motion passed unanimously.
2. A. The first application to be considered today is for the issuance of a Class “ABH” alcoholic beverage license to SMC Fargo JV, LLC d/b/a Fargo Courtyard to be located at 2249 55th Street South.
There were no questions or comments regarding this application.
Moved by Sprague, seconded by Larson to approve the issuance of a Class “ABH” alcoholic beverage license SMC Fargo JV, LLC d/b/a Fargo Courtyard to be located at 2249 55th Street South, all voted in favor, motion passed unanimously.
3. Chief Todd commented about the Point of Last Drink discussion that is circulating. He is concerned that we define the issue we are trying to address, we need to be definitive. Our current records management system is a shared system with two counties and multiple jurisdictions. There would be programing needed to accommodate the additional tracking information.
Carol Schlossman representing the Downtown Neighborhood Association said the goal is education talking about the Point of Last Drink is essentially a data-gathering tool that will allow us to modify behaviors moving forward. It is being utilized in a number of cities in Minnesota, tracking over intoxication and underage service. Patterns have appeared which have allowed some behavior modification. A liquor license is a privilege not a right. It is already illegal to serve underage or overly intoxicated patrons. The data is gathered from events officers are already responding to such as DUI, Domestic Assault, and Disorderly Conduct. They are not looking at one off situations but rather where a pattern shows up. In response to Commissioners Piepkorn’ s question, Ms. Schlossman said there are 20 plus cities in Minnesota where they have an ordinance regarding Point of Last Drink.
There being no further business to come before the Liquor Control Board, the meeting was adjourned at 1:36 p.m. The next regular meeting will be held Wednesday, October 17, 2018 at 1:30 p.m. in the City Commission Room at old City Hall.
