BOARD OF APPEALS
February 21, 2019
Members Present: Chairperson, Clay Dietrich, Mark Honzay, Mike Wild, Jeff Furstenau, and Justin Schoenberg.

Chairperson, Clay Dietrich, called the meeting to order.
Item 1 – Approve the Minutes of the January 24, 2019 meeting.
Mark Honzay motioned to approve the minutes of the January 24, 2019 meeting. Mike Wild seconded the motion. All members present voted aye, and the motion was declared carried.
Bruce Taralson requested a change of order of agenda allowing the review of the International Existing Building Code (IEBC) to take place before unfinished business. The board agreed to his request.
Item 3 – New Business
a). Review of International Existing Building Code, all Chapters.
Commercial Plan Reviewer, Peter Valkov, presented the International Existing Building to the Board.
Mr. Valkov stated that in the past the City of Fargo has allowed the use of Chapter 34 from the 2012 International Building Code for existing buildings. He furthered that per the Inspections Department’s observations during the past three years, staff recommends adding a local AMENDMENT deleting Chapter 34 from the IBC as it is a duplicate of Chapter 5 of the IEBC.
Mr. Valkov summarized significant changes to the Board.
Chapter 1 – Scope and Administration
Section 101.1 – Staff recommends continuing the exiting local AMENDMENT inserting the City of Fargo as the jurisdiction.
Section 101.2 – Section clarifies detached one and two-family dwellings, townhomes up to 3 stories to comply with the IEBC and the IRC.
Section 104.2.1 - Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 104.2.2.1 - Staff recommends continuing the existing local AMENDMENT which states, “The code official is authorized to require an existing building to be investigated and evaluated AT OWNER’S EXPENSE by a registered design professional based on the circumstances agreed upon at the preliminary meeting. The design professional shall notify the code official if any potential non-conformance noncompliance with the provisions of this code is identified.”
Section 104.8 - Staff recommends continuing the existing local AMENDMENT which states the following:
“This code shall not be construed to relieve from or lessen the responsibility of any person owning, operating, or controlling any building or structure for any damages to persons or property caused by defects, nor shall the code enforcement agency or the City be held as assuming any such liability by reason of the inspection authorized by this code or any permits or certificates issued under this code.”
Section 104.10.1 - Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 105.2 - Staff recommends adding a local AMENDMENT adding the following items to work exempt from permit:
7. Reroofing
8. Window replacement
Section 105.2.2 - Clarification is made to certain cases of repair work requiring a building permit while other repair work would not require permit.
Section 106.2.5 - New section is added to the IEBC. Special attention is placed on protecting the structural portions of buildings due to moisture penetrating in the building.
Section [A] 109.1 - Word “visible” added for clarification in the general section. (two instances) as indicated in this code edition.
Section 109.3.3 - Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section [A] 109.3.6 - New section added. Special attention is placed on protecting the structural portions of buildings due to moisture penetrating in the building.
Section [A] 110.1 - Changed is the name of the section from “Altered Area Use and Occupancy Classification Change” to “Change of Occupancy” and text in the body of the section is altered to reflect the change of occupancy.
Chapter 2 – Definitions.
Section 201.3 - Staff recommends continuing the existing local AMENDMENT which states: “Wherever the term “International Plumbing Code” and/or International Private Sewage Disposal Code” is used, it shall mean the North Dakota State Plumbing Code. Wherever the term “ICC Electrical Code” is used, it shall mean the National Electric Code together with the North Dakota Wiring Standards. Wherever the term “Flood Hazard Area” is used, it shall mean the Fargo Flood Plain Management ordinance together with the Flood Proofing Code of the City of Fargo, North Dakota.”
Section 202 - Added or changed definitions for: Alteration, Approved, Building, Change of Occupancy, Disproportionate Earthquake Damage, Existing Structure, Registered Design Professional, Repair, and Substantial Structural Alteration. Substantial Structural Damage was further clarified and expanded. Removed: Loadbearing Element, Rehabilitation Seismic.
Chapter 3 – Provisions for all Compliance Methods.
Section 301.1 - Section changed to reflect the change in the order of chapters in the new IEBC.
Section 301.2 - New section. Reflects the relocated Chapter 4 – Repairs.
Section 301.3 - Section explains how to achieve compliance for alterations, additions, or change of occupancy.
Section 301.3.2 - Changes reflect the changed chapter numbers in 2018 IEBC. Section numbers changed to reflect the new sequence.
Section 301.4 - New section explains the relocated buildings are to comply with Chapter 14.
Section 301.5 - New section points at ICC A117.1 – 2009 for reference. Existing buildings shall comply with the ICC A117.1.
Section 302.2 - Section was relocated from other part of the book. Old section was 1206.2.
Section 302.5 - Section was clarified. The text, “that unsafe conditions are not created” was added.
Section 302.5.1 - New section added. Structural members to comply with the requirements in the IBC. One exception was added also.
Section 303 - New general title section. Structural loads are combined in this code to apply for all compliance methods.
Section 303.1 - New section added to address live loads in additions and alterations of existing buildings.
Section 303.2 - New section added to address snow loads.
Section 303.3 – New section added.
Section 303.3.1 - Section was revised. Title was revised from “Compliance with International Building Code-level seismic forces New section. Table was revised to say “FULL” seismic forces.
Section 303.3.2 - Section was revised, title was revised from “Compliance with reduced International Building Code-level seismic forces. Table was revised. Sub-notes under table were revised.
Section 304 - New section. Refers to IBC, Chapter 17 – Special Inspections and Tests – 1708 In-Situ Tests.
Section 305 - Section does not show change, however this section and all subsections were relocated from 2015, Chapter 4 (s. 410).
Section 305.1 - Section describing maintenance, change of occupancy, additions and alterations to existing buildings and historic buildings. Section was relocated from Chapter 4 (section 410) ACCESSIBILITY FOR EXISTING BUILDINGS.
Section 305.4.1 - Reference sections were updated.
Section 305.4.2 - “At least” changed to “not fewer than” in four locations.
Section 305.6 - “Less than level 3” was changed to “where work area is 50 percent or less of the aggregate areas of the building.”
Section 305.8.1 - Section moved from old code section 705 Accessibility / section 705.1.1 – Entrances. The only change is that the reference section has been updated.
Section 305.8.4 - New section added. New escalators and stairways; an accessible route shall be provided to the levels per IBC.
Section 305.8.9 - “Pose hazard” is changed to “restricts”.
Section 305.8.10 – Change is indicated. However, no change in actual text could be determined.
Section 305.8.11 - New section added. Section is explaining the requirement for ADDITIONAL toilet and bathing facilities and clarifies the requirement for accessible and assisted-use toilet and bathing rooms.
Section 305.9 - Section was relocated from old 1204.1. Name of section changed. “Code official” is changed to “authority” and section references were updated.
Section 305.9.1 - The text, “at least” was changed to “no fewer than”.
Section 305.9.3 - The text, “at least” was changed to “no fewer than” and “main entrance” was changed to “public entrance”. Signs shall be provided.
Section 305.9.4 - “At least” changed to “no fewer than”.
Chapter 4 – Repairs.
Section 401.1 - Reference to Section 502 was removed as no longer relevant.
Section 401.2 - Section was moved to this location.
Section 401.3 - Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 402.1 - Subsections deleted from previous book are 602.1, 602.2. Section 603.3 is now 402.1.
Section 405.2.1 - “Unless otherwise required by this section” added to this section for clarification.
Section 405.2.1.1 - New section. Refers to – repairs, or replacement of damaged structural components, or to compliance with the requirements in the IBC – s. 1608.
Section 405.2.2 - New section referring to damage caused by earthquakes. It refers all work to be compliant with the following section – Substantial Structural damage to vertical elements.
Section 405.2.3 - Changed is the reference section, as chapters have been revised in the 2018 IEBC. Repairs are Chapter 4 now instead Chapter 6. Change in exception 1: word “rehabilitated” was replaced with “retrofitted”. Change in exception 2: word “rehabilitated” was replaced with “retrofitted”.
Section 405.2.3.1 - Section change happens at end of section where the new section has eliminated the words: “International Building Code-level seismic forces”.
Section 405.2.3.2 - Reference section changed.
Section 405.2.3.3 - Referenced section changed to reflect new code organization. Word “rehabilitation” was changed to read “retrofit”. Seismic loads are corrected by removing the words: “International Building Code-level seismic forces”.
Section 405.2.4.1 - Reference to other sections changed due to switched chapters. Exception: 1. “rehabilitated” changed to “retrofitted”. Exception: 2. “rehabilitated” changed to “retrofitted”.
Section 405.2.5 - Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 406.1.4 - Section was clarified, however, the intent stays the same.
Chapter 5 – Prescriptive Compliance Method.
Section 501.1 - Relocation removed. Reference section number changed.
Section 501.1.1 - Relocation removed. Reference section number updated.
Section 501.2 - New section added.
Section 502.1 - Except the number of this section, there is no apparent change.
Section 502.2 - New section referring to damage caused by earthquakes. It refers all work to be compliant with the following section – Substantial Structural damage to vertical elements.
Section 502.3 - Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 502.4 - Section provides additional clarity without change in intent. Sections referring to other parts of the code were updated. Exception for buildings Group R is added.
Section 502.5 - Removed last part of the section which used to refer to ASCE41. Exception 2 is added in the 2018 IEBC – referring to Group R buildings.
Section 502.7 - New section added. Addresses the need for CO alarms in existing portions of a building.
Section 502.8 - New section added. Storm shelters will be required in group E facilities per referred section.
Section 503.1 - References to other sections in this code were updated. Exception 3 added. Below grade transportation stations – existing and new escalators shall be less than 32 inches wide.
Section 503.2 - Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 503.3 - Section was changed to require replacement or alteration to structural elements in case of increased loads due to alteration (more than 5%). The option of evaluating the structural element is taken away. Previous exception is taken away and two new exceptions are added:
Exception 1: Group R occupancies.
Exception 2: If a new roof layer is added.
Section 503.4 - Section was simplified by taking out certain references ASCE 41. No change was noted in the exception to this section.
Section 503.5 – Section was simplified. Second half of the section was removed.
Section 503.6 - Section was simplified.
Section 503.7 - New section added to address concrete and reinforced masonry walls.
Section 503.8 - Section was simplified, clarification added for floor lines to be provided with wall anchors.
Section 503.9 - Section was simplified.
Section 503.10 - New section added. Adds clarity for masonry partitions anchorage requirements in seismic zones.
Section 503.11 - New section added. Adds clarity if an alteration of area over 50% receives substantial structural alteration. Reference is made to IBC, Chapter16 for structural design.
Section 503.13 - Section was clarified compared to s. 403.9 in IEBC 2015.
Section 503.15 - New section added. Addresses CO alarm requirements in this new code.
Section 503.16.2 - No change appears to be made to this section.
Section 504.5 – Section changed with addition to ‘within 10 feet of fire escape stairways”.
Exception was added for approved sprinkler system.
Section 505.2 - The text, “and one- and two-family dwellings, and townhouses regulated by the International Residential Code” was added to this section. #3 rule changed.
Section 505.3 - The text, “and one- and two-family dwellings, and townhouses regulated by the International Residential Code” was added to the section. IBC reference sections were updated.
Section 505.4 - New section added. Addresses the need for operational openings.
Section 506.1 - Change of occupancy compliance – section rephrased with meaning staying the same. Exception now refers to the IBC.
Section 506.1.1 - The text, “building official” was changed to “code official”.
Section 506.4 - Section was shortened to say the change of occupancy shall meet the requirements of the section.
Section 506.4.1 - New section added. Addresses tributary live loads in case of change of occupancy.
Section 506.4.2 - New section added. Addresses snow loads in case of change of occupancy.
Section 506.4.3 - New section added. Addresses seismic loads in case of change of occupancy.
Section 506.4.4 - New section added. Addresses access to Risk Category IV buildings and makes reference to the IBC.
Section 507.3 - Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 507.4 - Historic Buildings – refers to compliance with the structural provisions of Chapter 5.
Exception #2 added to clarify Substantial Damage.
Section 1206.2 – Section was deleted.
Chapter 6 – Classification of Work.
Section of Repairs - Deleted Section 502 (and created a new chapter – Chapter 4 Repairs).
Chapter 7 – Alterations – Level 1.
Section 701.3 - Staff recommends continuing the existing local AMENDMENT delete section in its entirety as it relates to flood.
Section 701.4 - Section was revised as a new section and clarifies the requirements for emergency escape and rescue openings. Emphasis is placed on the ability of the occupants to be able to escape without the use of key or tool.
Section 702.4 - “On replacement windows” was added at the title of the section.
Section reference to the IBC was added.
Section 702.5 - Section 702.5 in the 2015 IEBC was revised to clarify replacement windows used as emergency escape and rescue openings. Clarification was made to the requirements in the IRC with two conditions listed.
Section 705 – Accessibility was deleted.
Section 705.1 - Exception 1 was expanded. Exception 2 was added to clarify recovering and replacing existing roof covering in regards to secondary / overflow drains which otherwise would be required
Section 705.3 - Previous code section dealing with both roof replacement and roof recover was broken into new sections. This one sets the requirements if a replacement is intended.
Section 705.3.1 - Clarifies installation of new roof covering over existing roof covering and the conditions that may occur.
Section 705.3.1.1 - Clarifies when and where roof recover shall not be permitted.
Section 706.2 - Section was re-written to better clarify requirements for new equipment on existing roof and load implications.
Chapter 8 – Alterations – Level 2.
Section 801.1 - Reference section added.
Section 801.3 - Reference section updated. Two new exceptions added to clarify escalators in below-grade transportation stations and alternative design criteria for new structural members.
Section 802 - “Special Use” and “Occupancy Sections” were deleted.
Section 802.2 - Reference sections updated. “At least” changed to “not less than” or “not fewer than” in several exceptions.
Section 802.2.1 - Each level, considered separately has “At least” changed to “not less” one-half of its individual required exit capacity.
Section 802.2.2 - Reference sections were updated.
Section 802.4.1 - Reference sections were updated.
Section 802.5 - Reference sections were updated.
Section 803.2 - Reference sections were updated.
Section 803.2.2 - The text, “all” was changed to “both”.
Section 803.2.2.1 - Reference sections were updated.
Section 803.3 - Exception clarified. The requirements and required values kept the same.
Section 803.4 - Referenced section numbers were updated.
Section 803.4.1 - Referenced section numbers were updated.
Section 803.2.4 - Referenced section numbers were updated.
Sections 804 and 804.1- Sections were added with one subsection.
Section 804.2.4 - Section has been relocated.

Section 805.2 - Means of egress exception 1 – a word is changed from “conforming” to “complying”. No change in the general meaning of the paragraph.
Section 805.3.1.1 - Section has been re-written. In this version it includes tables for maximum occupants for stories with one exit – one table (805.3.1.1 (1)) is dedicated to R-2 occupancies and the other (805.3.1.1 (2)) for other occupancies.
Section 805.3.1.2.3 - Stairways shall be “at least” is changed to “not less” than 22 inches.
Section 805.3.2 - “At least” is changed to “not fewer than” in regards to required means of egress.
Section 805.3.3 - The text, “at least” was replaced with “not less”. Exception is clarified, no change.
Section 805.4.1.1 - The text, “minimum” was replaced with “not fewer”.
Section 805.4.1.2 - The text, “minimum” was replaced with “not fewer”.
Section 805.5.1 - The text, “At least” is changed to “not less”. Exception 4: “maximum” changed to “not more” and “may be omitted” is changed to “not required”. Exception 5: “at least” is changed to “not less than”.
Section 805.9.1 - Changed to read not fewer than one handrail. Not fewer than one side.
Section 806 - Section was deleted.

Section 906.3 - Section is clarified for requirements to meet – in IBC, s. 1609 and 1613.
Section 906.4 - Appears to be a new section that clarified requirements for installation of wall anchors and roof and floor lines for flexible roof diaphragms. In essence old sections were reworked to better reflect structural requirements in existing buildings.
Section 906.5 - New section that provides requirements for wall anchors at roof line. This section is derived from old book and reworked to meet and better clarify requirements in existing buildings.
Section 906.6 – Section was clarified.
Section 906.7 - New section. In specific seismic categories anchoring is required in un-reinforced partitions and non-structural walls adjacent to egress paths.
Section 907.2 - Section was deleted.
Section 907.3 - Section was deleted.
Chapter 10 – Change of Occupancy.
Section 1001.2.1 - Reference section in IBC has changed.
Section 1001.2.2 - Reference section in IBC has changed.
Section 1001.2.2.1 - Reference section in IBC has changed.
Section 1003.1 - Reference section in IBC has changed.
Section 1005.1 - Reference section in IBC has changed.
Section 1006 – Accessibility section has been deleted.
Section 1006.1 - Section of gravity loads has been re-written under new name – Live Loads.
Section 1006.2 - Section was clarified and re-phrased. No real change in meaning.
Section 1006.3 - Seismic loads have been revised to address the issues for change of occupancy through the IBC and not through IEBC sections. Exceptions: Three exceptions were transferred from old section 1007.3.1 in IEBC 2015 into this section and also simplified/clarified in the process.
Section 1006.4 - Risk category IV now is referred to the IBC.
Section 1009.4 - Second condition has been revised to keep the same meaning.
Section 1011.1 - References to other sections updated to meet changes in the book.
Section 1011.1.1 - References to other sections updated to meet changes in the book.

Section 1103.3 – Staff recommends adding a local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 1105.1 - New section – sets requirements for certain occupancies to receive such alarms in existing buildings during addition projects.
Section 1105 – Section has been deleted.
Sections 1106, 1106.1 and 1106.1.2 - New section that sets requirements for storm shelters in additions to Group E occupancies.
Chapter 12 – Historic Buildings.
Section 1201.4 – Staff recommends continuing the existing local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 1202.2 - New placement for the section “Replacement”.
Section 1202.3 – Section has been relocated.
Section 1203.4 – Section has been relocated.
Section 1203.5 – Text, “walls and ceilings” were deleted from this section.
Section 1204 – Section has been deleted.
Section 1205.1 - Exception 1 – added text, “and existing live loads”. Exception 2 – new exception added to provide clearance with substantial structural damage in historic buildings.
Section 1206 – Section has been relocated to this location.
Chapter 13 – Performance Compliance Methods.
Chapters 13 and 14 were reversed in order in the 2018 IEBC.
Section 1301.1 – Text, “repair” deleted.
Section 1301.1.1 - Text, “repair” deleted.
Section 1301.2 - Text, “repair” deleted. Reference to specific year has been removed as well. (Structures existing prior to [DATE TO BE INSERTED BY THE JURISDICTION. .. ]).
Section 1301.2.3 – Text, “and this code” was deleted.
Section 1301.2.3.1 – New section added. Storm shelters shall be provided per Section 1106.1.
Section 1301.2.4 - Alterations and repairs section has been modified to address alterations only, as repairs has been separated.
Section 1301.2.5 – New section added. Escalators will be allowed to be narrower than 32 inches in transportation stations whether escalators are new or existing.
Section 1301.3.3 – Staff recommends adding a local AMENDMENT deleting this section in its entirety as it relates to flood.
Section 1301.6 – Text, “or other codes” was added.
Section 1301.6.6 - “(VO)” added. (“VO” Stands for Vertical Opening).
Section 1301.6.6.1 – VO clarified.
Section 1301.6.7.1 - Solid vertical line shown. However, it is not clear what was changed in the HVAC systems article #5.
Section 1301.6.8 - “N/A” and “N/P” clarified under Table 1301.6.8.
Section 1301.7 - Sub note “a.” added at the bottom of table.
Chapter 14 – Relocated or Moved Buildings.
Section 1401.2 – Staff recommends continuing the existing local AMENDMENT which states the following: “Buildings to be moved within this jurisdiction shall comply with provisions of this chapter. Buildings to be moved into this jurisdiction shall comply with the provisions of the International Codes for new buildings and shall be certified as to that compliance by an agency approved by the code official.” The building shall be safe for human occupancy as determined by the International Fire Code and the International Property Maintenance Code. Any repair, alteration or change of occupancy undertaken within the moved structure shall comply with the requirements of this code applicable to the work being performed. Any field-fabricated elements shall comply with the requirements of the International Building Code or the International Residential Code as applicable.
Section 1402.6 – Staff recommends adding a local AMENDMENT deleting this section in its entirety as it relates to flood.
Chapter 15 – Construction Safeguards.
Section 1501.6.1 – The following text was added: “A walkway shall be provided for pedestrian travel that leads from a building entrance or exit of an occupied structure to a public way.”
Section 1505.1 – Section changed to require stairways at 40’ instead of 50’.
Section 1505.2 - Text, “Required accessible means of egress” was added. Exception reflects the new required accessible means of egress.
Section 1506.1 - Standpipes are now required during construction to be “adjacent to stairways” and “complying with s. 1505.1”.
Item 2 – Review of Previously Covered Sections requiring review.
Due to time constraints, the Board opted to postpone the discussion of previously covered sections requiring further review, Agenda Item 2, to the meeting scheduled for Thursday, March 21, 2019.
