Liquor Control Board - March 20, 2019 Minutes

LIQUOR CONTROL COMMITTEE MEETING
March 20, 2019 1:30 P.M.

Present: Commissioner Piepkorn, Deputy Police Chief Anderson, Deputy City Auditor Jill Pagel, Grant Larson, Environmental Health
Absent: Commissioner Gehrig,
Others Present: Assistant City Attorney Alissa Farol, Other members of the media, concerned citizens and other members of the industry.

Meeting was called to order at 1:30 P.M.

1. Commissioner Piepkorn called the meeting to order and asked if there were any additions or corrections to the minutes of January 16, 2019. There were no additions or corrections to the minutes. Moved by Larson, seconded by Anderson to approve the minutes of the January 16, 2019 meeting of the Liquor Control Board all voted in favor, motion passed unanimously.

2. A. The first application to be considered today is the issuance of a Class “H” alcoholic beverage license to Pho D’Licious located at 623 NP Avenue.

Pagel stated this is a new Class H license, beer only, with the only concern being that the Inspections department has not yet approved this location for a building permit. Piepkorn stated we had 2 options; the first would be to approve contingent on the approval of the building permit or second would be to continue this application until the next Liquor Control meeting in April. Larson stated this is a major consideration, not a minor issue and that it would not make sense to approve at this time. No one from Pho D’Licious was present to speak on their behalf as to the progress of the permit. Larson moved to continue this application to the April meeting, Anderson seconded the motion. The motion was unanimously approved to continue to next meeting.

B. The second application is a transfer of a Class FA alcoholic beverage license from Transcendent Hospitality Group LLC dba Four Points by Sheraton to Fargo South Hospitality LLC dba Four Points by Sheraton to be located at 5064 23 Ave South.

Pagel stated this is a Class FA, full service application with ownership changes only, no issues from Auditors. Anderson stated they had no issues with either credit or criminal check. Larson also had no issues from the Health Department. Moved by Larson, seconded by Anderson to approve a Class FA license. Motion unanimously approved.

C. This application is for a transfer of a Class B-Limited alcoholic beverage license from Lakemode Liquors Inc dba Lakemode Liquors to Cashwise Liquors LLC dba Hornbacher’s Wine & Spirits to be located at 4265 45 Street S, Suite 121.

Pagel stated this also is an ownership change with no issue from the Auditor’s office. Anderson did not uncover any issues with either the credit or criminal background check. Larson had no issues with the application from the Health Department. Anderson moved to approve, seconded by Larson, motion approved unanimously.

D. The last application is the issuance of a Class H alcoholic beverage license to CRA3 Investments LLC dba Wingstop to be located at 2653 45 Street South.

Pagel stated this application is for a beer only license at a new establishment in town and had no issue. Anderson had no concerns with credit or criminal background. Larson had no concerns from the Health Department. Larson moved to approve the Class H license, Anderson seconded the motion. Motion was approved unanimously.

There being no further business to come before the Liquor Control Board, the meeting was adjourned at 1:47 p.m. The next regular meeting will be held Wednesday, April 17, 2019 at 1:30 p.m. in the City Commission Room at City Hall.
